A new independent review process is to be implemented.
The Acting Transport Minister, James Meager, has announced a new function that will enable individuals and organisations to seek an expert review of specified civil aviation regulatory decisions made by the Director of Civil Aviation. This move aims to simplify the appeals process for those affected by significant decisions such as licence cancellations or suspensions.
Under the new system, applications can be made for reviews of impactful decisions related to aviation documents, including pilot licences, air operator certificates and maintenance engineer's licences. The function will not cover medical certification decisions. Fees for review applications are set at $1,000 (excl. GST) for individuals and $1,500 (excl. GST) for organisations.
The new independent review function is expected to become operational on 5 April 2025, when the Civil Aviation Act 2023 comes into force. Acting Minister Meager notes that this will provide a more cost-effective and quicker alternative to the current appeals process in District Court, which can cost over $300,000 and take up to four years.
